Squeeze/Chapter not running during constraints

I've just started using the time constraints to convert tp (or smartchapter mpg2) and have noticed that with the time set up at 10:00pm - 8:00am nothing starts until 5:20am.

I'm on XP/SP2 (what a rush) and using 4.9.1 as I hear there are more problems with 4.9.2 and the HD-PVR then then it's worth.

The jobs ARE submitted and waiting long before the time starts, so I'm lost as to why they are not starting until really late within the constraints.

FWIW, when the time constraints are NOT in force, it starts the conversion straight away.

It isn't waking up at the right time. When I wake it in the morning, to check it, it starts right then.
