It has been a couple of years since I read the regulation and resulting interpretations of it, but at the time the prevailing interpretation was that they had to pass through EVERYTHING. If you could get their HD transmission over the air, they had to provide the HD version over their cable in the clear. It did not explicitly stop them from playing games like re-mapping the channels every week to screw up your tuner, but it did require them to provide the channel.
